Compliance Officer

As Compliance Officer of fundcraft France, the group’s portfolio management company authorised by the AMF as an AIFM, you play a pivotal role in ensuring the company’s compliance with French and European regulatory standards by supporting the RCCI (Responsable de la Conformité et du Contrôle Interne), a function currently held by the Country Head and RCCI of fundcraft France. You are the day-to-day owner of the compliance and internal control framework of the company and of the funds it manages.

The role is designed to grow: depending on your development and on the expansion of the company, it is intended to evolve towards the RCCI function.

As a key user of the fundcraft platform, you continuously provide feedback to enhance its functionalities while staying engaged in its technological advancements. Finally, you adhere to established procedures and best practices while championing fundcraft’s business objectives and committing to the achievement of the company's KPIs as updated from time to time.

This position is based in Paris and reports directly to the Country Head and RCCI of fundcraft France.

Key Responsibilities

• Support the RCCI as part of the second line of defence of the company and be involved in all matters related to compliance, internal control and professional ethics;
• Contribute to the definition of the annual second-level control plan and carry it out (AML/CFT, ethics, conflicts of interest, valuation, delegation and outsourcing, marketing and distribution, sustainable finance), in coordination with the external provider in charge of the periodic controls;
• Formalise the control sheets and conclusions, issue recommendations and follow up the related action plans with the teams;
• Monitor regulatory developments (AIFMD 2, AMF doctrine, SFDR, DORA, AML package), assess their impact and keep the procedures, policies and risk maps (non-compliance, operational, conflicts of interest) up to date;
• Run the ethics framework: conflicts of interest register, personal transactions, gifts and benefits, staff declarations;
• Issue compliance opinions on new funds and new mandates, and review the regulatory documentation of the funds (fund rules, KID, SFDR disclosures) and their marketing documentation, in line with AMF doctrine;
• Perform the due diligence and the ongoing controls on distributors (banks, CIFs), delegates and critical service providers;
• Apply the AML/CFT framework and notably:
• the AML/CFT procedure and risk classification of the company and of the funds it manages;
• the review of the onboarding of complex and high risk investors/counterparties, including the KYC files prepared by the group operations centre, and their escalation to the RCCI for decision;
• the review of the ongoing monitoring and regular sample checks on the investor and asset database;
• the asset freeze screening and the preparation of Tracfin reportings for the RCCI;
• Organise AML/CFT and compliance trainings to staff members and assist the first line of defence on KYC/AML and regulatory requests (Advisory);
• Record and handle complaints and compliance incidents, and follow up the remediation actions;
• Draft the periodic compliance reports to the senior managers (dirigeants effectifs) and to the group compliance function;
• Prepare the annual reports and questionnaires to be filed with the AMF (annual control report, annual information sheet, AML/CFT and DORA questionnaires) and keep the programme of activity and the ROSA filings up to date;
• Coordinate external audits, depositary reviews and AMF requests or inspections;
• Support the DPO on GDPR compliance and assist in the definition and the conceptualisation of compliance related platform features, in coordination with the tech and product teams.

Requirements

• Master’s degree (Bac+5) in law, finance, audit or compliance.
• 3 to 5 years of experience in compliance, internal control or regulatory advisory, ideally gained within a portfolio management company, a depositary, a regulator or an advisory firm, with exposure to private markets.
• Good knowledge of the French and European framework applicable to AIFMs (AIFMD, Code monétaire et financier, AMF General Regulation and doctrine, AML/CFT, SFDR, PRIIPs).
• Hold the AMF certification or be willing to obtain it shortly after joining, with the ambition to progress towards an RCCI position.
• Fluent in French and English, both written and spoken, English being the working language of the group.
• Autonomous, rigorous and well organised, with strong analytical and drafting skills, attention to detail and the ability to manage multiple deadlines.
• Pragmatic and diplomatic, able to build trusted relationships with internal teams, clients, distributors, the depositary and auditors, and to propose practical solutions that align with regulatory requirements.
